#1 - interpretation

"Company" means Global Web Edit Ltd owner of SetForeHire brand name
"Customer" means the purchaser of Goods from the Company
"Goods" means all goods sold and/or delivered by the Company to the Customer
"Terms" means these terms and conditions of sale
"Equipment" means golf clubs, golf shoes, golf bag, golf umbrella, golf bag cover
"Hire" means the process of leasing equipment from Company to Customer for a specified duration.
"Offer" means an agreement provided by the Company to the Customer comprised fully of the desired equipment for the desired duration.
"Purchase" means the transfer of ownership of equipment from Company to Customer
"Delivery" means presenting the Equipment to the Customer
"Collection" means presenting the Equipment from the Customer to the Company
"First Hire Day" means the day specified by the Customer for delivery of equipment
"Last Hire Day" means the day specified by the Customer for collection of equipment

#2 - application

2.1. These Terms apply to all contracts for the sale and Hire of Goods by the Company
2.2. No amendment, alteration, waiver or cancellation of any of these Terms is binding on the Company unless confirmed by the Company in writing.
2.3. The Customer acknowledges that no employee or agent of the Company has any right to make any representation, warranty or promise in relation to the Goods or the sale of the Goods other than as contained in these Terms.

#3 - booking

3.1. The Customer shall create a binding agreement with the Company by fulfilling the following stages of the booking process
3.1.1. The Customer shall select the Equipment item, First Hire Day and Last Hire Day
3.1.2. The Company shall build an Offer from the provided information
3.1.3 The Customer shall be invited to accept the Offer and Terms of the Offer
3.1.4. Payment shall be made according to Terms outlined in section 4
3.1.5. A confirmation of the payment shall be sent to the Customer with a unique booking number
3.1.6. The Customer shall provide a delivery and collection address no later than 24 hours prior to first day of the agreed hire period, failure to do so shall result in cancellation and payment in full, as per 5.1.4.
3.1.7. A single set surcharge of $15 per set per day will be levied on all bookings.

#4 - constraints of booking

4.1. The Customer shall create a binding agreement with the Company by fulfilling the following stages of the booking process
4.2. The Company shall accept and process advance bookings no later than 24 hours of First Hire Day.
4.3. Minimum Hire duration shall be one day and fractions of one day will be charged the equivalent of one day Hire.
4.4. Maximum Hire duration shall be 4 calendar weeks.
4.5. The Company shall make every effort to supply Equipment outlined in the booking agreement. However circumstances beyond the control of the Company may prevent the provision of pre-ordered Equipment. In such eventualities, the Company shall provide the Customer with Equipment of equal value and specification.

#5 - booking cancellations

5.1. The Customer can facilitate cancellations to bookings by informing the Company via email. Cancellations via telephone will not be accepted. An administrative charge of 10% of total transaction balance shall be levied against all cancellations. The following penalties shall apply to all cancellations.
5.1.1. More than 15 days prior to First Hire Day - Full Refund
5.1.2. 14 days to 7 days prior to First Hire Day - 70% Refund
5.1.3. 6 days to 48 hours prior to First Hire Day - 30% Refund
5.1.4. Less than 48 hours prior to First Hire Day - 0% Refund

#6 - booking modifications

6.1. The Company shall make every effort to cater fully to all requests for alterations to Hire dates and Equipment types. All modifications shall be subject to availability. Modifications cannot be accepted 24 hours prior to First Hire Day.

#7 - costs

7.1. Prices are determined at the time of order and are subject to change without notice.
7.2. Company reserves the right to levy additional fees against the Customer under the following circumstances:
7.2.1. Loss of Equipment - a value equivalent to the recommended retail price (RRP) of the item and full charges for Hire Duration
7.2.2. Damage to Equipment - a value set by an independent assessor appointed by the relevant Equipment manufacturer and full charges for Hire Duration
7.2.3. Stolen Equipment - a value equivalent to the recommended retail price of the item and full charges for Hire Duration
7.2.4. Cancellation - as per cancellation policies outlined in section 5.

#8 - payment

8.1. Payments are to be made to the Company without any deduction or discount other than as stated in these Terms or in the relevant invoice or statement.
8.2. The balance of the invoice price must be paid in full before delivery.
8.3. All transactions, whether Hire or Purchase will be transacted via a valid credit card.
8.4. By accepting the Terms, the Customer authorizes the Company to charge the Customer’s credit card for outstanding amounts, including amounts chargeable against damaged, missing, late return, stolen and lost Equipment, and amounts payable under the terms and conditions of this Agreement.

#9 - delivery

9.1. Delivery will be made to the location specified by the Customer in the booking process
9.2. Delivery will be made at the date and time specified by the Customer in the booking process
9.3. Changes in delivery location and time shall be conveyed to Company at least 3 hours before delivery time. Failure to do so will incur cancellation penalties as specified in section 5
9.4. Any failure on the part of the Company to deliver Equipment within any specified time does not entitle the Customer to repudiate the contract with regard to the balance remaining undelivered.
9.5. Customer shall be responsible for all items of equipment charged to the credit card stipulated in the booking agreement.
9.6. To release equipment the Customer shall produce a copy of passport, the transaction credit card, a copy of the booking confirmation.
9.7. Customer shall sign a release form that will serve as a binding agreement with the Company on the visual state of repair of Equipment supplied.
9.8. By signing the release form the Customer agrees to take full responsibility for the upkeep and safe keep of the Equipment.
9.9. Should the Customer be in any way dissatisfied with the Equipment, the Company shall make ever effort to locate and supply a replacement of equal value. Should a replacement not be available, the Customer shall have the option to cancel the booking, and shall be liable to penalties as outlined in rules of Cancellation in section 5.
9.10. Unless advised otherwise, deliveries to Bangkok and surrounds - a radius of 50km - will be made without charge.
9.11. Deliveries to the destinations of Hua Hin, Pattaya, Chiang Mai and Phuket will incur a handling charge of $25 per set per booking to cover the costs of delivery. A maximum charge of $75 per booking will be incurred.

#10 - collection

10.1. Collection will be made from the location specified by the Customer in the booking process.
10.2. Collection will be made at the date and time specified by the Customer in the booking process.
10.3. Changes in collection location and time shall be conveyed to Company at least 3 hours before collection time. Failure to do so will incur late return penalties as specified in section 7.
10.4. The Customer shall produce and sign the release form that shall serve as a binding agreement with the Company on the visual state of repair of Equipment returned.

#11 - duties and responsibilities

11.1. The Company is duty-bound to deliver Equipment as per booking agreement, that satisfies all aforementioned Terms.
11.2. Customer is duty-bound to satisfy the following:
11.2.1. Use Equipment for the sole purpose of golfing activities.
11.2.2. Maintain a high level of care for all items
11.2.3. Inform the Company immediately of any damage or loss
11.2.4. Permit ad hoc inspection of Equipment by the Company
11.2.5. Return Equipment in a timely manner
11.2.6. Return Equipment in the same condition and state of wear as that received on First Hire Day.

#12 - miscellaneous

12.1. The Company reserves the right to recall Equipment when the Company suspects or becomes aware of violations to aforementioned duties and responsibilities.
12.2. Upon repossession the Company reserves the right to charge in full for any unused Hire duration.

#13 - limited liability

13.1. These Terms do not affect the rights, entitlements and remedies conferred by applicable local Trade Practices Act(s).
13.2. The Company is not subject to, and the Customer releases the Company from, any liability (including but not limited to consequential loss or damage) because of any delay in delivery or fault or defect in the Equipment. The Customer acknowledges that the Company is not responsible if the Equipment does not comply with any applicable safety standard or similar regulation; and, liable for any claim, damage or demand resulting from such non-compliance.
13.3. If any statutory provisions provisions under the Trade Practices Act(s) or any other statute apply to the contract between the Company and the Customer then, to the extent to which the Company is entitled to do so, the Company’s liability under the statutory provisions is limited, at the Company’s option, to:
a) replacement or repair of the Equipment or supply of equivalent Equipment; or
b) payment of the cost of replacing or repairing the Equipment or acquiring equivalent goods; and
In either case, the Company will not be liable for any consequential loss or damage or other direct or indirect loss or damage.

#14 - warranty

14.1. All Equipment is covered by such warranties as are specified by the manufacturer and supplied subject to the Equipment standards detailed by the manufacturer.
14.2. On discovery of any defect in the Goods, the Customer must immediately notify the Company of such defect. The Customer must not carry out any remedial work to alleged defection Equipment without first obtaining written consent of the Company to do so.
14.3. The Customer expressly acknowledges and agrees that it has not relied upon, and the Company is not liable for any advice given by the Company, its employees, agents or representatives in relation to the suitability for any purpose of the Equipment.

#15 - contract

15.1. The terms of the Contract are wholly contained in these Terms and any other writing signed by both parties. The Contract is deemed to have been made at the Company’s place of business where an order was placed and any cause of action is deemed to have arisen there.

#16 - force majeure

16.1. The Company will not be liable for any breach of contract due to any matter or thing beyond the Company’s control (including but not limited to transport stoppages, transport breakdown, fire, flood, earthquake, acts of God, strikes, lock-outs, work stoppages, wars, riots or civil commotion, intervention or public authority, explosion or accident.

#17 - severability

17.1. If any provision contained in these Terms is held by a court to be unlawful, invalid or unenforceable, the validity and enforceability of the remaining provisions are not affected.

#18 - governing law

18.1. These Terms and the Contract shall be governed by the law of Thailand and the parties submit to the courts of Thailand in respect of any dispute arising.

#1 - administration

1.1. an administration charge will be levied against all cancellations

#2 - refunds

2.1. refunds will be paid according to the notice given by the client
2.2. 15+ days prior to delivery - full refund + 10% administration charge
2.3. 14 days - 7 days prior to delivery - 70% refund + 10% administration charge
2.4. 6 days - 2 days prior to delivery - 30% refund + 10% adminstration charge
2.5. less than 48 hours prior to delivery - no refund + 10% administration charge
2.6. no show - no refund + 10% administration
